SMS Policy
1. Scope and Purpose
This SMS / Text Messaging Policy (“Policy”) governs how Accura Billing Solutions LLC (“Accura Billing,” “we,” “us,” or “our”), a Montana limited liability company, collects consent, sends, and manages SMS and MMS text message communications with clients, prospective clients, and other individuals who opt in to receive such communications.

The information (Phone Numbers) obtained as part of the SMS consent process will not be shared with third parties for marketing purposes.

- Appointment Reminders – Reminders for scheduled consultations, onboarding calls, or follow-up meetings related to billing services.

- Customer Care – Messages providing support and assistance related to your account, service inquiries, and ongoing client communications with Accura Billing Solutions LLC.
- Two-Factor Authentication (2FA) – Outbound verification messages sent to confirm your identity when accessing your account or completing a secure action with Accura Billing Solutions LLC.
3. How We Obtain Your Consent
We obtain express written consent before sending any SMS messages, in compliance with the Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227, and applicable FCC regulations.

Please note that standard message and data rates may apply, depending on your carrier’s pricing plan. These fees may vary if the message is sent domestically or internationally.
7. TCPA and Applicable Law Compliance
All SMS communications by Accura Billing Solutions LLC comply with:
- The Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227;
- FCC regulations implementing the TCPA, including 47 C.F.R. Part 64;
- The CAN-SPAM Act (for email-based consent workflows);
- State-specific consumer protection laws in states where our clients are located, including California, Texas, Virginia, Colorado, New York, and Florida.
We do not use automatic telephone dialing systems (ATDS) or pre-recorded voice messages without separate, explicit consent as required by law.
8. HIPAA Considerations
As a medical billing company operating as a HIPAA Business Associate, Accura Billing Solutions LLC takes special care to ensure that SMS messages do not contain Protected Health Information (PHI) unless (a) required for the delivery of a specific transactional service and (b) transmitted over a HIPAA-compliant secure channel. Appointment reminders and billing notifications are structured to minimize the inclusion of PHI and are subject to our Business Associate Agreement obligations with covered entity clients.
9. Data Retention and Privacy
SMS consent records, including the date, time, IP address, and method of consent, are retained for a minimum of six (6) years in accordance with HIPAA record retention requirements. Consent records are stored securely and are accessible upon request by the individual who provided consent.

10. Changes to This Policy
